Two of the Three Petitions Against FDEP Permit Voluntarily Dismissed
Cape San Blas Development, LLC, and Mr. & Mrs. Woodman voluntarily dismissed their petitions on Friday, August 24th. The one petition remaining with a request for an administrative hearing is that of Michael Nicholson, Kate O'Brien Nicholson, and White Sands of Navarre, LLC.
As co-chairs of the SJPBAC, we wish to express our deepest appreciation to Cape San Blas Development, LLC and Mr. & Mrs. Woodman for voluntarily dismissing these petitions in an attempt to allow the project to move forward again. Remember, we have gotten this far in what could easily be called the state's fastest beach restoration project with the most obstacles to overcome *only* through our unity and community spirit. Let's all stay focused on finding a solution to getting our project released from this final petition so that we can continue to work toward our goal of a restored beach.
We have asked FDEP if they will be able to request an expedited DOAH hearing on the remaining petition so that hopefully the permit can be issued as soon as possible. The status of that request as well as the outcome of our discussion with legal counsel on what we can do to try to get our project released from this situation will be discussed at our meeting on Friday (see previous blast). Although delays are now inevitable regardless of when this final petition is cleared or dismissed, we are still hopeful the situation can somehow be resolved to allow us to begin construction soon enough that we do not lose our allowed construction window for this year. (Construction is allowed under the permit through July 1, 2008. If we begin too late into our construction window, we will not be able to complete the project in one season.)
